ITAR LICENSING

US businesses dealing in defense (military) products and services found on the US Munitions List (USML) are subject to extensive licensing control under the International Traffic in Arms Regulation (ITAR). ITAR governs the exports of all defense-related technology transfers and the permanent and temporary export and temporary import of defense related articles and services. EAR LICENSING

Most goods and services not covered under the International Traffic in Arms Regulation (ITAR) are subject to regulations under the EAR – The Export Administration Regulation. The EAR is administered by the Department of Commerce, Bureau of Industry and Security, (BIS) which is the agency that issues export licenses for commercial (non-defense) goods and services if they are required.

FD Associates can help you determine whether or not your product is subject to EAR and whether it needs a license from the BIS to export the product to the country you are exporting to.

DETERMINING EAR EXPORT LICENSING REQUIREMENTS

Your international business transactions must always be properly authorized for export. When exporting commodities controlled by the EAR, this can often mean determining that no license is required and documenting that conclusion. Sometimes it means implementing a complex export process control system including applying for the required export license, exporting in compliance with the license and the EAR, and establishing the required record keeping and reporting procedures. The regulations imposed by the United States government on international trade can be confusing for someone trying to understand correct export licensing requirements and establishing licenses and export compliance measures on their own.

EAR LICENSE APPLICATIONS

Under the EAR there is only one form: the 748-P form, which is used for a variety of EAR export authorizations including temporary or permanent exports of commodities or technology transfers. EAR license applications are submitted to the Department of Commerce, Bureau of Security and Industry via the BIS's electronic Simplified Network Application Process- Redesign system (SNAP-R). We can assist by drafting the application for you, or we can provide a peer review of your license application. We can fully act on your behalf to file EAR 748-P export license applications directly into the SNAP-R system and we can track the application's status through government review and provide regular updates on the review status on an ongoing basis.
